Hi to evrybody,

How can the purchaser be sure that the vessel he bought will be free from any encumbrances?

Which documents / titles should be delivered by purchasing the yacht?

If it is registered under part I you should be able to check SSR does not register any debt against the vessel.
If buying through a broker get him to sign an indemnity or take out an indemnity insurance,
Don't forget that lovely latin phrase "caveat emptor" = buyer beware.

Part 1 and Small Ships Register (Part 3) are not one of the same. Just google "Part 1 register" and "ssr" and you'll get MCA descriptions. The RYA have a specimen Sale Agreement that I found invaluable and also publish a handbook to guide you through the process. For a registered boat a formal bill of sale will/should be used to ensure transfer of registery ownership and to satisfy the vessel is free from encumbrances.
