Do I go after the surveyor, or not?

My Windy is still out of the water but progress is being made. The new tank is fitted and work has moved onto the outdrives. Now - bearing in mind when I had the boat surveyed, I asked the surveyor to pay particular attention to the outdrives becuae I knew the motors had been replaced using the old drives.

Turns out that my marine engineer called me on Saturday to say he had removed the drives and that they needed some attention. Attention meaning knackered bellows; full of crud including various crustacia. Basically the engineer has had to strip and rebuild these drives.

Being a reasonable chap, I had just about resigned myself to all these problems, but this one was the last straw.

I guess I have answered my own question - I'll be giving trading standards a call today!!

have you contacted your surveyor and aired your concerns?? i personnally would give him the chance to redress the issues, if then you get no joy then resort to contacting his proffessional body with your complaints.That should spur your man into action. No need at this juncture to contact trading standards,usually they will only react, if there have been multiple complaints,about an individual or company.

I wish you the greatest of luck, there are some serious half wits out there posing a surveyors and hiding behind the small print when they're caught out. I recently heard of one very well known surveyor tapping all over the teak deck on a Princess 435 in the hope of finding rot in the hull.

As I say I wish you luck with your complaint but I thing the small print and disclaimers will add another entry to the list of ones that got away.

I'm surprised the surveyor did'nt exclude engine/drives from his survey which they usually do 'coz they're not mechanical engineers. Also, for sure, there will be a statement somewhere in the survey saying that only an external visual inspection was possible. If you've got it in writing that the surveyor accepted your instruction to survey the outdrives or it states this in the report, you may have a case but otherwise I would think not

Yes, you have missed something Alistair!!.

My new (to me) Windy 8800 has had a couple of problems...Firstly the petrol tank ruptured in rough seas, sending 25 gallons of unleaded into the engine bay - the base of the tank was as rotten as a pear. Luckily my son and I weren't blown to the promised land.

While getting a new tank made and fitted, the marine engineer also spotted drive leg problems in spite of the fact that I had specifically instructed the surveyor to pay particular attention to these.

The boat has been out of action now for 3 weeks and I'm itching to get back on it as the season is drawing to a close.

Hence my asking the learned panel about going after the surveyor as some sort of redress.

i believe that you can look for redress. But as with anything tha goes legal, you need a paper chase. Bills/estimates to put right, photos of the problems, and another survey report confirming that the previous one was no good. With that lot the original surveyor can be gotten hold of. Niot usre abt trading standards -don't you want a solicitor?

At this stage, Trading Stds have advised that I send a recorded delivery letter detailing all the problems and associated costs. His reply will drive my next action. That action could be the small claims court or we could agree to settle an amount. Ball will be in his court.

Unless you instructed the surveyor to dismantle the legs and inspect internally(not really cost effective),or may be requested that he took the boat for a run to listen for funny noises etc from outdrives,he will prob not accept liability for what may be just wear and tear bellows and seals type maintainace.Again unless you specifically requested the tank be removed the same will apply.This is the classi case of the previous owner has avoided the routine maintaince and you have suffered as a result.
So you ask,why employ a surveyor,mmm...good question.

By-the-by...I have had the new tank coated and aluminium etched before installation.

I am not at all sure that I can get any redress on this but being as it costs nowt to instigate the small claims procedure, I shall go down that route and see what turns up.

The thing that really naffs me off is the number of surveyors that seem to be getting away with this with impugnity according to all the replies on here.

Look sUrveyors are crap. Me or you could be one. You look at the outside of things and voice an opinion. Little letters says its only an oppinion. They dont pull engines to bits or look in small corners. The bloke that surveyed my boat said it was a bit mucky. But then it would hve been having stood in the yard all winter. They may be worth a bit more than nothing but not alot else. Use eyes and spend some time. A surveyor is just a money grabing git but only my opinion!!

Think two schools of thought regards surveyors.If you are really really keen on particular boat, intend buying come what may and have money to be able to buy it.
Then get survey to try to avoid worst of major problems and may be offer 95% of asking price.
Alternative is.Look at several boats and then deduct enough from asking price to be able to fix any possible major grief and offer remainder to seller.
