Chartplotter out of date

last year i bought a chart plotter from a Chandlers in Hull,the unit malfunctioned last weekend.I contacted Navmans agents plastimo and they have informed me that the unit was manufactured in 2005 and is therefore out of warranty.

so i paid the RRP for a two year old unit

dont think it matters when it was made - the warranty runs from date of purchase, provided you registered the unit. Failing that, the bill of sale should do it. Ring em back and ask them about your rights under the European Sale of Goods legislation.

The unit serial number indicates the 5500 was manufactured in 2005 and is out of warranty.

Assuming that a chart plotter of merchantable quality is supposed to last more than a year, your recourse is to the seller you bought it from under the sale of goods act. The manufacturer's warranty is a bonus. The time for use of the warranty is probably set out in the warranty terms and that might be date of purchase or date of maufacture. I would take it back to the chandler and ask for repair (its probably too late to reject it) or if they cannot do that the current equivalent unit. Failing that use the small claims process against the chandler. You have a better case against the chandler than asking a small claims court to interpret the terms of a warranty. There are a whole load of other issues about the enforcability of warranties as contracts which i wouldn't even want to go into here.

ive spoken with the chandlers in Hull and they were most helpfull,firstly they tracked down my receipt and confirmed that there is a 2 year warranty.

now it is down to Plastimo/Navman
