charging for anchoring

I heard(read?) somewhere that as a resul;t of some court action or other, it was found that charging for anchoring in UK is not actually legal? Is this just another urban myth or marine legend? I ask having been told that I will be charged same amount for anchoring in Camel river as for berthing alongside in Padstow harbour?

Sailing today ran a campaign against this sort of charging a while ago. Certain rivers (beulieu being one of them) have some sort of royal charter which allows them to charge I believe. Though I think there are not many that have this. I guess if you are within a harbour then they can probably charge tho I would certainly argue it.

No need to argue, as they put it in Sailing Today, Just ask if they have a legal right to charge and can they show you evidence of it, ie produce the Royal Charter, if not then give them your name and address so that they can send you a copy of the evidence and if they would like to send an SAE you can forward a cheque to them.
you are not refusing to pay so they can't do much without the evidence of the Charter.

Like most other things the answer is not simple.

Any charges for anchoring could be justified in court as a levy for the use of harbour navigation marks.

In addition there are certain rivers (the Beaulieu is one) where the local landowner has rights.

However any charge could be resisted as an attempt to illegally restrict your rights of free passage.

It's law in Spain and France that anchoring in a harbour is free.

In the UK it's just confused.

I read them, but I can't remember which harbours had a legal right. I know Newtown creek is one place that charges without a right, but I haven't been there yet despite it being only a shot day-sail away. I haven't been charged for anchoring for many years now so I haven't tried out the advice. it certainly sounds like resonable advice though.
