Thanks, Neal, an interesting post. Trouble is, if you try the 'free circulation' (circulation libre?) argument with a French harbour authority, they will still march you down to the cash point and tell you to argue the case through the French courts later - which is not the easiest thing.

This sounds broadly like my own understanding based on conversations with HMCR in the past.

They refused to issue me with a certificate on the grounds that there was no need for me to have one. They pointed out that a British registered vessel was only subject to British jurisdiction in terms of VAT status, and that other EU jurisdictions had no right to demand any payments or even proof in this regard. Since they were satisfied with the VAT status of my vessel, there was no need for any further action

They did advise me to point this out if I was subject to VAT examination whilst abroad in the EU but I suspect I'd take the easy way and simply produce my VAT receipt in the hope it would speed their departure

we are powerless in any real sense, even if we theoretically have the law on our side.

A close friend is a UK Customs Officer at a very well known UK harbour. He is adamant that, if he wants to check VAT paid status, he can do.

As said elsewhere in this thread, this whole area needs sorting out urgently, and HMRC are disgracefully unhelpful.

It is a bit rediculous - after all - we don't have the VAT status of our cars checked when stopped by policemen - either here or abroad ... so why do the waterbourne officials worry so much ... ?

But the RYA STILL have not nailed those b.....rs in HMRC down. My experience was near 10 years ago. How long does this farce need to go on . For one ,I'm uninterested in claims of on going discussions.... what about some action. Although its unsurprising where HMRC are concerned. I own a proerty they rented and vacated nearly two years ago ......still getting letters ,and they are current replies to questions recently asked by them.. so they clearly cannot even administer themselves properly, let alone our interests.Useless and not on our side....ranting again!

not true for a pre-73 boat - you are mixing it up with regulations for boats built post 73

Because they don't have anyone to account to. Best thing would be to get shot by one of them for resisting arrest and then we could have our beloved leader demanding an explanation from the french authorities. otherwise grin & bear - the Greeks I can assure you live in fear of their coast guards who will frog march anyone away in handcuffs just because they feel like it.

What are you going on about. I thought everybody had now learnt that the term "public servant" only meant government money collection service. If there is no money in it for the government then there is no effort put in to it.

I believe the police and all government agencies should have written on signs etc "to serve the public "as the reality is now "to fleece the public" using every means possible ie CCTV to late filling in of forms etc etc.

Does 'original bill of sale' mean literally the very same piece of paper that the yard/salesman handed over at the time of first purchase, or are copies of that same document acceptable?

Dunno, I showed them the orginals. But they weren't really happy with them anyway and it was only original builder's invoice showing VAT that did the trick.
