I'm looking at the possibility of buying a Spanish Registered yacht and bringing her back to the UK. Note - this is a private sale so a little more complicated.....or is it ?

1) Has anyone here successfully done this ?
2) If so, how did you organise the money and transfer etc.
3) How did you draw up agreement of sale
4) There's also a mention of a 6 month guarantee, how does that work ?
5) any handy web sites ?

Any tips / advice appreciated be it good or bad

You will need to have the boat deregistered and the registration papers should show clear title and VAT payment. May be worth using a broker or a gestor (sort of legal bod) to check out the paperwork.

Payment depends on the method you choose and what is acceptable to the vendor. Most straight forward is a bank transfer, but that locks you into bank's exchange rate. OTOH it is not expensive and secure.

Agreement is what you and the vendor agree. Ideally use a UK type contract but the important bit is to ensure you get good title when you hand over the money.

Don't know about a 6 month guarantee. Sounds a bit suspect unless the vendor is backing it with some form of third party guarantee.

I think it would be fairly straightforward. You have all the usual considerations of a purchase in the UK, plus the issue of de-registration in Spain and registration in the UK. Tranona's suggestion of using a gestoría seems a good idea: pick one in a town with a big marina and they will almost certainly have experience of the things you need. Ask them before employing them. UK registration (SSR) is dead simple online.

A specialist foreign exchange company will give you a much better exchange rate than a bank. Try HiFX, or one of the others. You do a BACs payment to them from your UK bank. They send a transfer to your seller, or your gestor, or your non-resident account at a Spanish bank. If the money doesn't go straight to the seller, you will incur another transfer cost (not a lot) when the money is transferred internally in Spain.

In Spain, debts move with the property, including boats, so make sure there are no outstanding marina bills etc. Again, a gestor can help.

1 yes :)

2 bank transfer for the deposit and a rucksack full of euros for the balance. This is not a recommendation, but you did ask what I did. It did allow me to screw the price down some more. I paid less than half the asking price.

3 used an mCA bill of sale. The Spanish registration system is great. It lists every change of owner, name change, mortgage etc and if the vessel is IVA (vat) paid. I had this translated into english - a broker arranged this for me and arranged deregistration. It proves ownership up to the point of the upper box of the mca bill. I also had photocopies of the passport of the signatory.
