Presumably you bought the boat in the EU and you're a business? Otherwise not sure what you mean.

There's only one lot of VAT to pay.

no i am not a business, private buyer.

ok, perhaps i misunderstand the prob, but if i buy a second hand boat outside the EU, say the USA it will then have attracted state taxes.

can i claim those back when i export the boat from the usa to the uk?

If you buy a used boat in the USA and export it within a short qualifying period you won't pay sales tax. You can't claim back sales tax paid by others on the same boat.

Brian, the RCD thingy results from the rulings changing in 2004 and now being applied. However, I had a conversation with CEProof in the UK a couple of weeks ago, and yes you are correct when you mention about the exemption rules, but they also said that they, amongst others in the EU, thought the new ruling would be all but unworkable. Yes the external noise test would be simple enough, but as for the emissions testing, this was a whole different issue.
How many older engines are there even emissions data for. Very few, they suspect. The more common engines fitted to older cruising boats like the Perkins' and Ford Lehmans etc, have no history regarding emissions, nor is there any parts available to enable them to be brought up to the standard.
Their (unofficial) line was to ignore it as they think it is untenable.
Can you just imagine all these people having to remove the engines from their boats to send them to a lab to have them tested and the costs involved. Never mind the horrendous cost in replacing all these older engines. Then there is the question of the polution caused in destroying these older engines. I think that would probably outweigh the benefits of changing them.

my reading of the regs when first aired, was that the noise reading had to be in situ, to measure the actual noise the boat made with the engine and exhaust in use. So would mean the boat would have to be motored back and forth past a microphone, not take engine out to measure engine noise?

may be possible to reclaim tax in USA ask local tax office (american)and ask for forms on exporting the boat.
This is same suituation as in UK before joining EU when you could reclaim tax paid on vehicle (back about 10 years)when exporting vehicle to Europe.I exported several (expensive) sports cars in those days and received lots of re turned tax.

In the EU a transaction has to be 'VAT qualifying' (new or used but purchased by a VAT registered entity from a VAT registered entity) to reclaim VAT.

If you purchase an item Tax paid in the US you may be able to recover the taxes on exit. You can in some states of Canada but not others for instance. The first question to ask is going to be over the pond.

On import to the EU you pay duty and VAT at the point of import. Rates vary a little from EU State to State.
