if a boat has AIS transponder, could the owner use that to track its location

Yes one could as long as it was in range of a shore based receiver and left turned on. More than a few miles offshore and its unlikely any owner will be able to track his own boat. Most of us that have them fitted prefer to turn them off when moored or having reached our destination.

Would need the power on to the nav kit. If it's been stolen, might well happen if the perpetrators turn things on at some point, but if it's a mooring failure then most unlikely.
