Are Marina Anal Contracts worth reading ?

Has anyone read their Marina annual contract ?
What are the significant differences ?
If MBM published the highlights could we encourage all marinas to offer the best of both ?

Here are a few examples that I have herd about but happy to be corrected by anyone who is in these Marinas

Lyminton Yacht Haven let you sub let your berth

Premier credit unused berthing over 21 days to next year

MDL give you a raffle ticket to win a bottle of wine or summer scrub



If you sell your boat in a Premier marina you dont pay a commission (2 per year)

If you sell your boat in MDL you pay 1.5 % to MDL/Broker


If you give your berth up mid term MDL just charge the monthly rate
Premier keep the years money unless they let your berth for an annual contract (why should they when they can let it monthly and charge twice for it ?)

Premier sell fuel at cost
MDL sell less 10% ( assuming they dont load it first this will be valuable after nov 08)

MDL no BBQs on pontoons

MDL give you free 15 nights in other MDL marinas
Premier give you just 12 free nights

What other querks/perks are there ?
 
As moving permanently (well one year anyway) to Northney I've just read the contract. MDL say you have to let them know every time you leave the berth /forums/images/graemlins/crazy.gif and also that you have to leave your berth at least twice a year. MDL also state no hanging out the washing /forums/images/graemlins/shocked.gif

I didn't pay MDL 1.5% when I sold my boat a couple of years back from Northney.... and yes they were well aware. Must admit I don't recall seeing that clause...

I am sure I had read 1.5% boat sale charge back in 2004 when my Cornich was for sale, and I thought I had read in MBM about a disgruntled boater feeling ripped off, perhaps it was a long time ago , went to court and MDL had to remove it /forums/images/graemlins/confused.gif
Anyone else remember anything about it ?

I thought there used to be a 1% commission in the Premier contract (when not sold by resident broker). I'm not aware of a court case on the subject but I wouldn't have fancied a marina operator's chances of successfully enforcing such a charge.
 
Well, 10pct off: MDL might continue on the low tax fuel sales, but I doubt the company intends to offer 10pct off your new higher tax !
 
I think they could have done a little Boo-Boo, they have already given their berth holders a contract to say they will give 10% off fuel, this will continue until April 2009.

It will either give their berth holders a good deal or they will have to load the pump price forcing none MDL berth holders to buy elsewhere ?
 
The 1% commission seems to be common. My mooring contract states that on the sale of the boat I have to pay them 1%.

Some other gems include them being able to change the price of electricity without giving any notice, no washing hung up to dry, any servicing work on boats must be done by the marina's contractor, no external contractors allowed without written permission (this creates an interesting dilemma as this clause prevents a BSS examiner coming to inspect your boat without written permission). The company reserve the right to exercise a general lien upon any property left at the marina including vehicles. Boats have to be kept clean and if they fall below the level expected will be removed from the marina and no refund given.

I'm sure these are all fairly standard conditions. I once also received a letter from the marina saying I was in breach of contract for leaving my tender tucked away in front of my boat.
 
Premier Port Solent charge contractors £10 per day at port solent to wash your boat.

MBL About £5 per day,

2 weekly wash can cost you an extra £260 to Premiers
