Johnny Foreigner biffed me Bav whilst on holiday. Admitted liability and exchanged Insurance details. Just received the attached and just need to confirm:

Does his Insurance Company accept liability?
Are they asking for just one estimate?

Mercy bucket.

Suggest you re-post picture with your address covered up.

Erm, what time do you go out in the mornings?

EDIT. Or is it the address of your insurance company? /forums/images/graemlins/blush.gif

I agree-ish. They are saying that their client seems to be responsible (semble engagee). And can he have a quote for the repair.

They are saying that their client appears to be responsible. They would like a quote, but do not require a "rapport d'expert". An "expert" in France is a professional in charge of estimating damage for the insurance companies. IE, they would be happy with a local quote.

I'm no expert but roughly translated you appear to have a choice between 2 years service with The French Foreign Legion or banishment to a penal colony off Guadaluope for a similar period.

Reading through the nitty-gritty it seems that the other party - a Monsieur Guiot aboard yacht "Figaro" claims you failed to observe his "I am French and can do what the hell I like" pennant and that you failed to apologise after he crashed into you.

It may seem unreasonable but they appear to have you bang to rights!

"Given that according to the photo, it's only a small ding in the gelcoat, let us have a quote for the fix, without getting a surveyor involved and we'll settle it." sort of

Well M Baratay may speak French, but he can't write it (and doesn't have a decent spell checker). When you send off your (inflated) estimate to M Baratay, you may want him to write out 5 times:
nos intérêts
qu'a subi le bateau
de votre assuré

and suggest that "missionner" is not a verb accepted by l'academie française.

Truly is.

Lots of help and still cracked up over Ravens answer.

It was OBVIOUSLY my fault for being securely moored to a pontoon with my fenders in the wrong place /forums/images/graemlins/frown.gif

Well, they start off by apologising for their tardy response, which is fair enough. After that it all goes a bit pear shaped as they reckon you rammed them with sufficient force to whack their gelcoat back several centimetres. Furthermore, the reckon you're a bit of a sinister character and definitely on the make - apparently they have a massive dossier on you compiled by an expert in these matters

The bit I don't like is the 'Restant a votre disposition' which is a thinly veiled threat that they know where you live and can easily send the boys around with their 'sentiments distingues' which roughly translates as attitude

I'd let your insurance deal with it and find a quiet hotel to hide in for a few weeks

Similar thing happened to us Bav 34 - tied to jetty - hit by French boat. Our claim was totally successful BUT it may be worth noting:
The French insurance company paid out the claim minus an excess of several hundred euros.
It was then the owner of the other boat who had to make a direct payment to us for the remainder of our claim.
To be fair, he did so without any hassle, but it did cause a bit of anxiety intially as to whether this would be successfully resolved.
Don't know if this is common to all French policies or not!

Thanks Cynthia. ''Luckily'' this guy doesn't have an excess. and had never heard of one.
The reason that I know is that I thought it might be easier all round if he just paid me his excess and I use that to get the boat repaired in the UK. Would have kept the Insurance Companies out of it.
