Another VAT question

My boat was built in the UK in 1982 and purchased by me in 2015 (before breaksit) - So I am told it was VAT exempt ...
After I bought her, I re-flagged to US . Now that Delaware is not renewing , I want to "reflag" her to "European" flag.
Will I have to pay VAT or is she still considered VAT PAID in the EU?

Flag has no bearing on VAT. Where did you buy the boat and where have you kept it? If for instance you purchased it in the EU or purchased it in the UK and took it to EU before B day and it has remained based there under your ownership, no VAT should be payable.

Tank you! We bought it in Lefkada in 2015 and it was in Greece till 2019 (on and off the hard). 2019-2022 in Turkey. Now back in Greece. US flag but I need to change flag at the end of the year.

Greece has some peculiar laws/rules from what I read here so maybe others based there can give you more accurate information.

As I see it (which may not be correct in Greece) you purchased the boat in EU, sailed abroad for a while and then returned it under the same ownership so no VAT should be due. If Greece accept the VAT status is OK now, changing flag shouldn't make any difference.

Did you officially check-in when you returned to Greece from Türkiye. If so, under what mechanism - Returned Goods Relief or Transit log?

On the face if it you are VAT EXEMPT by way of age. But this can be lost by overstaying 3 years in Turkey. So dates please on leaving Greece and coming back.
ALSO how and where did you check out and where did you check back into.

You would have most certainly have had to visit Customs after immigration, where they would have given you an 18 month limited transit log on recognition of Temporary Admission to the EU. OR if you said you were vat exempt they should have given you an UNLIMITED transit log. You must have one or the other....

The limited one needs to be handed in, and all transit logs need to have ports that you have visited stamped on the TL, both in and Out.

If you don't have a TL of any sort you could be in for some hefty fines....

I take ot you are paying the ETEPAI Cruising Tax?
