Inverness Court - this one was under H&S and the accused pleaded guilty.

It would appear that H&S legislation is either easier to obtain conviction (not just this case but others including Jean Charles de Menezes) or has better prosecutors than some other legislation. Perhaps the MCA should change their strategy.

I have read the MAIB report and a sad catalogue of errors it recounts. My memory of the conclusions included a cavalier approach to risk assessment with a gung-ho attitude that led to the unsuitable use of equipment in a dangerous manner that led to the death of a young lass. I didn't draw a comparison with the LV case other than wonder if the MCA might have fared better under H&S.

A very valid conclusion and one which I alluded to in an earlier post on the HL thread.
 
Agreed it is a very sad case and as sombody who has taken young people mountaineering I was quite shocked at the poor planning and incorrect equipment that was being used. LV was just a poor call on by the skipper to either not sail or to run for port.

I wonder if the MCA can prosecute under H&S legislation?

you don't need the the MCA to prosecute.
If there had been a fatality amongst the crew of LV, I'm sure that a manslaughter charge would have been considered.
