Abandoned yachts?

How do you go about encouraging a yachtsman who has abandoned his yacht on a Club mooring and ignores letters requesting he repairs his pride and joys Rudder damage! More to the point pay his outstanding fees! Meanwhile other members have to keep a watch on his pride and joy! Allegedly is not strapped for cash!
The RYA process is long-winded to say the least! But we will keep on the pressure for payment. How do others bring this type of owner to book!
To rub salt in the wound he is also a member of a down river Yacht Club were he has yet another vessel .
Not just a local , as there appears to be many clubs and marinas with this type of problem!
 
AFAIK the RYA process is the only real legal route that you can take. There is another guide here https://www.blakemorgan.co.uk/training-knowledge/guides/recovering-outstanding-berthing-fees/ but have not compared side by side.

Realistically - unless the boat is worth £20k plus you will probably end up losing money due to the costs of enforcement.

MY suggestion would be to push hard with the legal threat / notice to sell the boat and hopefully find a friendly solicitor who may be prepared to assist. Maybe you have a member who is a solicitor and who could give specific advice?

Finally - look for ways to cover yourself and communicate the message to the owner. SO if you have a committee meeting to discuss expelling the member for non settlement of debts then use that to ratify the decision to seize and sell the boat and ask members to let friends know if they want to buy ONCE THE LEGALITIES are complete
 
Considering that all members sign acceptance of club rules on joining you don`t know what your getting until a period of time passes! Majority become enthusiastic Club members and can be relied on, just the odd one!:rolleyes:
 
Your options will be dependant on you legal relationship with him. What do you t&cs state?

Generally you have;
CCJ - depending on the debt value I believe it is as little as £60 to file. Sometimes just the completed paperwork sent recorded can de enough. Could offer to write off debt if vessel is removed etc.
Tort - Under tort you can take possession of the vessel in lieu of debt and sell to cover debt.
Admiralty marshal- not sure on the process myself

I'm sure there are more.
 
Fragile things, these mooring strops. Part just like that, they can, if a boat is abandoned for a bit. Cause a lot of damage. Shame if something like that were to happen.
